The Central Bureau of Investigation (CBI) recently informed the Bombay High Court about the need for one day to seek instructions regarding a plea filed by Showik Chakraborty, the brother of actor Rhea Chakraborty. Both siblings had been embroiled in the Narcotic Control Bureau’s (NCB) case related to the alleged drug use of the late actor Sushant Singh Rajput. Although they were arrested in 2021, they were subsequently granted bail, with a condition stipulating that they surrender their passports to the NCB and obtain court permission for international travel.

On September 6, a special court operating under the purview of the Narcotic Drugs and Psychotropic Substance (NDPS) Act granted Showik Chakraborty permission to travel abroad for work purposes in Australia. During this process, the court noted that the NCB had retained Showik’s passport without adhering to legal provisions. Under the Passport Authorities Act, only the passport authority has the authority to impound a passport.

Showik’s petition in the Bombay High Court, filed by advocate Ayaz Khan, underscored a significant point. It highlighted that in the previous year, Rhea Chakraborty had been granted court permission to travel for the prestigious IIFA awards. However, she could not exercise this privilege due to the standing Look Out Circular (LOC) issued against both her and her brother by the CBI.

To provide some context, the controversy surrounding Sushant Singh Rajput’s untimely death began in July 2020 when an FIR was filed in Patna by the actor’s father. The allegations in the FIR included accusations that Rhea Chakraborty had taken money from Sushant and had incited him to commit suicide. Consequently, the case was transferred to the CBI by the Supreme Court of India. During the course of their investigation, the CBI issued lookout notices against both Rhea Chakraborty and her brother. These lookout notices effectively prohibited them from travelling abroad, even if they obtained court permission.

During the court proceedings, Ayaz Khan emphasized the urgency of Showik Chakraborty’s travel plans to Australia, which were scheduled between September 17 and 24. Consequently, he requested the suspension of the LOC for this specific period to enable Showik’s travel without legal hindrance.

The bench presiding over the case comprises Justice Ajay Gadkari and Sharmila Deshmukh. The upcoming hearing on Showik’s petition is scheduled for Friday, during which Advocate Kuldeep Patil will represent the CBI and present their arguments before the court.
